Trade Name Registration

A trade name, also known as a trading name or a business name, is the name which a business trades under for commercial purposes, although its registered, legal name, used for contracts and other formal situations, may be another. When appropriate and at Client’s request, BGI will file with appropriate authorities in the U.S. (NY State and Federal TTB) a “Client Business Trade Name” as a trade name (dba) of BGI. The Client could then use their Business Trade Name on product labels and marketing materials. 

For example, Client could include ‘Imported by ABC Winery, USA’ on bottle labels instead of Imported by Beverage Group International, LLC or BGI.

FDA Registration

The Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (the Bioterrorism Act) directs the Food and Drug Administration (FDA), as the food regulatory agency of the Department of Health and Human Services, to take additional steps to protect the public from a threatened or actual terrorist attack on the U.S. food supply and other food-related emergencies.

The Bioterrorism Act requires domestic and foreign facilities that manufacture, process, pack, or hold food for human or animal consumption in the U.S. to register with the FDA. All producer’s facilities are required to register, such as a bottling plant and warehouse.

To carry out certain provisions of the Bioterrorism Act, FDA has established new regulations requiring that: 
  • Food facilities are registered with FDA 
  • FDA be given advance notice on shipments of imported food.

  

Federal Label Approval

All labels on alcoholic beverage must be pre-approved by Alcohol, Tobacco, Tax Bureau (TTB). A certificate of label approval authorizes the certificate holder to bottle and import alcohol beverages that bear labels identical to those shown on the certificate of label approval. Labels are an important source of information for consumers. BGI will review labels to assure all mandatory requirements are met and submited for TTB approval.

 

State Compliance & Registration

Since the Repeal of Prohibition in the United States, the 21st Amendment to the United States Constitution on December 5, 1933, each state was allowed to set their own laws for the control of alcohol. These regulations vary from state to state. There are many rules and regulations that concern alcohol across the United States. Whether it involves when and where alcohol may be sold or who may consume. It is vital to understand and remain consistently compliant with all laws and regulations. BGI will handle all licenses, registrations, reporting, needed to do business in all States.

Brands and/or labels for alcoholic beverage products are required to be registered in certain States. The purchase by any licensed distributor of any alcoholic beverage without registration is prohibited.

State Price Posting & Reporting

Price posting of products sold to a licensed Wholesaler/Distributor are required monthly or yearly in certain States. The prices posted are the selling wholesale prices.

Certain States require a monthly Excise Tax/Gallon Report and/or Sales and Tax Rate report. The reports include a complete list of all product transactions per month. All reports and applicable tax payments are submitted monthly. The Excise Tax is imposed per gallon on all alcoholic beverages that are brought into that particular State.

 

Logistics Coordination

All the logistics to get your product from your warehouse to final US destination (port, distributor or warehouse). BGI will handle the order management, communication with Winery, Freight Transport Companies, Brokers, Distributors and Sales.

 

US Customs Coordination

From Importer “10+2” Security Filing to US Customs clearance BGI will ensure all documentation are sent to the correct parties for proper filing.

  

Distributor Invoicing

Upon shipment of product an invoice is issued to Distributor with terms agreed upon.  BGI will follow up to maintaining successful supplier relationships while optimizing your cash flow.

  

Inventory Management

BGI can set up warehousing in the US as an extension of producers facilities, send monthly activity reports and sales bills of lading.
